Georgia DUI Commercial CDL License
As a commercial driver, your ability to drive is more than a convenience.
It’s how you make your living. So if you have been arrested for DUI, you need an experienced DUI defense attorney. If you live in the state of Georgia, contact The Law Office of Larry Kohn, and don’t delay. After all, your employment is at stake.
Whether you were arrested for DUI because you failed a chemical test and were in violation of the “per se” law or you refused to submit to a chemical test, the Department of Driver Services will bar you from operating a commercial vehicle for 1 year.
In every state including Georgia, it is illegal for a driver to operate a motor vehicle with a blood alcohol content of .08% or more. However, that number drops to .04% if you are driving or in physical control of a commercial vehicle.
If you did submit to a chemical test, it is possible to have your CDL license reinstated after 120 days. This only applies to drivers who have no prior DUI convictions within a 5-year period. For those drivers who refused a chemical test, you will not be eligible to have your license reinstated for at least 1 year, and that includes driving vehicles other than commercial vehicles.
In the event that you were carrying hazardous materials as part of your commercial license, your license will be suspended for 3 years. Any commercial driver who has twice refused to submit to a chemical test or receives
2 DUI convictions within a 5-year period
will lose their commercial license for life. Unfortunately, Georgia is not one of the states that allow commercial drivers to have their license reinstated after a 10-year waiting period. Don’t let this happen to you.
Instead, contact The Law Office of Larry Kohn
. We represent commercial drivers who have been arrested for DUI.
We understand the importance of retaining your CDL, which is why we fight hard for your rights. If there are any weaknesses to expose in the prosecution’s claims against you, we will find them.
