Let’s say you were pulled over for a minor traffic violation, such as speeding slightly above the posted limit or running a red light. If the officer saw something that led him or her to believe you may be under the influence of alcohol, you may have been given a breathalyzer or other chemical test. Because federal law prohibits operating a vehicle with a BAC of 0.08% or higher, if the test revealed you had a BAC above this limit, you can be arrested for driving with an illegal amount of alcohol in your system—even if your ability to drive was not impaired at the time. This is what’s known as a “per se” DUI.
On the other hand, if you are stopped for driving erratically (such as swerving, excessive speeding, or driving on the wrong side of the road) and a chemical test indicates you have a BAC within the legal limit, you can still be arrested. Known as a “less safe” offense, this type of DUI charge is used in cases where a driver had a BAC below the 0.08% limit, yet was impaired to such an extent that he or she posed a significant threat to other motorists. In some cases, you can even be charged with both per se and less safe DUI.
The type of evidence that will be used against you in court will depend primarily upon whether you were charged with per se or less safe DUI. Typically, your chemical test results will be used to support a per se offense, while the officer’s testimony regarding your behavior and driving abilities will make up the majority of the evidence used in a less safe DUI case.
